Landlord and Tenant Law
Landlord and tenant law is composed primarily of state statutory and common law. A number of states have based their statutory law on either the Uniform Residential Landlord and Tenant Act (URLTA) or the Model Residential Landlord-tenant Code.
The basis of the legal relationship between a landlord and tenant is grounded in both contract and property law.
A landlord and tenant law relationship is either in lease or agreement format. Therefore, the length of tenancy is either for a given period of time, for an indefinite period of time, and terminable at any time by either party (at will) with a 30 to 60 days notice. The landlord and tenant law provisions in a lease are normally regulated under statutory law. Federal law under the Federal Fair Housing Act prohibits discrimination in housing and the rental market.
