A landlord tenant relationship starts with making the lease. The lease says that the tenant is using the land with the permission of the landlord. The lease is applicable for a prefixed time period after which the tenant has to return the use of the land to the landlord. In spite of the right of the land being the landlord's, the tenant can enjoy it for the lease period.
The lease, be it in written or verbal, launches the landlord tenant relationship. It is a dual agreement in which the tenant has to pay rent in return for the use of premises by the landlord.
Duties of the Landlord and Tenant
The Landlord must:
Uphold health & safety building and housing codes;
Keep the premises in a condition which is conducive to living;
Keep common areas protected and free from dirt;
Uphold all electrical, plumbing, heating appliances in proper order;
To provide cans and organize for removal of trash;
The tenant should be given the name and address of the owner.
The Tenant must:
Hold on to any rules provided by any health and safety laws;
Keep the building hygienic and secure;
Eliminate all garbage in suitable disposal areas;
Keep all fixtures and equipment in proper condition;
Not inconvenience the neighbors;
Pay rent on the due date every month;
Use the premises for legal purposes;
Avoid bothering other people.
